Welcome to ProperPins! These Terms of Service ("Terms") govern your use of our website and the purchase of our custom enamel pins and related products. By placing an order with us, you agree to be bound by these Terms.

1. Custom Orders and Proof Approval Because we manufacture custom products based on your specific artwork, the proofing process is critical.

  • Digital Proofs: After you submit your design and place an order, we will provide a digital proof of your pin for your review.

  • Approval Responsibility: It is your responsibility to carefully review the proof for spelling, color placement, sizing, metal plating, and overall design accuracy.

  • Final Production: Once you formally approve the digital proof, your order enters production. We are not responsible for any errors (e.g., typos, missing design elements) that were present in the approved proof. Any changes requested after approval may incur additional fees or may not be possible.

2. Intellectual Property and Copyright We respect the intellectual property rights of others and require that you do the same.

  • Your Artwork: By submitting a design to ProperPins, you warrant and represent that you are the sole author of the artwork, or that you have obtained all necessary rights, licenses, and permissions to use the artwork.

  • Indemnification: You agree to hold ProperPins harmless and indemnify us against any claims, damages, or legal fees arising from copyright, trademark, or other intellectual property infringement related to the designs you submit. We reserve the right to refuse any order that we suspect violates intellectual property laws.

3. Pricing and Payment

  • All prices are listed in USD and are subject to change without notice.

  • Full payment (or an agreed-upon deposit) is required before we begin the digital proofing and manufacturing process.

4. Production and Turnaround Times

  • Estimates Only: Manufacturing custom enamel pins is a multi-step, partially manual process. Any turnaround times provided (e.g., "21 days") are estimates, not guarantees.

  • Delays: Delays can occasionally occur due to complex designs, factory holidays, or shipping constraints. We will do our best to communicate any significant delays, but we are not liable for missed deadlines resulting from normal manufacturing variations.

5. Shipping and Delivery

  • Once your order leaves our facility, the shipping carrier is responsible for its transit.

  • We are not liable for delayed, lost, or stolen packages once marked "Accepted" or "Delivered" by the carrier. However, if a package is lost in transit, please contact us, and we will assist you in filing a claim with the carrier.

6. Returns, Refunds, and Remakes Because our items are custom-made to order, we do not accept returns or exchanges. Refunds or remakes are only issued for significant manufacturing defects, production errors, or incorrect quantities. 7. Limitation of Liability In no event shall ProperPins be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your custom order, including but not limited to lost profits or lost business opportunities, even if we have been advised of the possibility of such damages. Our maximum liability to you will not exceed the total amount you paid for the specific order in question.

8. Changes to These Terms We reserve the right to update or modify these Terms of Service at any time. Any changes will be effective immediately upon posting to our website.
